Amphi pour Tous - Towards a right to well-being?

The conference "Towards a right to well-being" , presented by Christophe BROCHE, lecturer at the Centre de Recherche en Droit Antoine Favre, Faculty of Law, will take place on Tuesday, June 6, 2023 at 6:00 pm at the Presidency of theuniversité Savoie Mont Blanc, rue Marcoz in Chambéry.

The conferences will be held subject to the health conditions linked to the Coronovirus (COVID-19) epidemic and in compliance with the safety regulations in force at the event venue.

ABOUT THE CONFERENCE

Well-being, which could be likened to happiness or quality of life, is a priori a non-legal concept. Many people, however, agree that legal mechanisms, such as compensation for damages, the right to eliminate neighborhood problems, environmental law, or subjective "rights to..." such as the right to privacy or to one's image, all pursue the same reality: the improvement of people's well-being. Although the right to well-being does not exist as such, it tends to impose itself today as a normality aiming at preserving a state of well-being (elimination of various nuisances, right to peace and quiet, right to a quality living environment, etc.), but also allowing to fight against ill-being (right to mental health, accompaniment of the elderly, of the sick). Should we see in this the beginnings of the forthcoming affirmation in our law of a right to well-being that can be invoked by all? How effective would this be? What would be its limits?
