CDPPOC Study Day: "TAG: Legal Outline of Vandalism"

October 26, 2017, 8:30 a.m. - October 26, 2017, 4:00 p.m.

On Thursday, October 26, 2017, the Center for Private and Public Law on Obligations and Consumption (CDPPOC) is organizing a study day on "Tagging: a legal overview of vandalism."

This event will take place from 8:30 a.m. to 4:00 p.m. in Building 20, Room 20020, on the Jacob-Bellecombette campus.

A FEW WORDS ABOUT THE STUDY DAY TOPIC

Graffiti is a widespread social phenomenon that is particularly visible in our environment. Broadly speaking, this phenomenon raises two key issues: environmental protection (the urban environment) and the exercise of freedom of expression.

Graffiti is a means of communication that is sometimes criticized for damaging the property on which it is displayed and thus infringing on public or private property rights. Graffiti is therefore necessarily viewed by the law from a restrictive perspective. The project therefore aims to determine how legal rules protect owners and, more generally, society against the harmful effects of this practice. To this end, the analyses will review the criminal prosecution of graffiti and the measures that may be adopted by the authorities to deal with this phenomenon.

Today, graffiti is increasingly becoming a true art form. This evolution inevitably raises questions about the legal protection of graffiti, with a view to potentially promoting it. The project therefore aims to identify which tags can be considered works of art and to analyze the contractual mechanisms that could be devised to enable tag artists to exploit their works.

The aim of the study day will be to demonstrate how the general rules of civil law, administrative law, urban planning law, and intellectual property law can be adapted to address the challenges posed by the practice of tagging.

The study day will be led by:

  • Mr. Christophe Broche – Lecturer in Private Law, University of Savoie Mont Blanc;
  • and Mr. Grégoire Calley – Lecturer in Public Law, University of Savoie Mont Blanc.
