ABOUT THE CONFERENCE

Automated analysis of court rulings, sentencing guidelines, and the standardization of the justice system are leading many companies to offer “predictive justice” tools. For example, in the United States, one company claims to calculate the risk of recidivism in order to determine prison sentences. In France, a company estimates, in advance, the amount of compensation expected in the event of a personal injury accident. These tools aim to predict the outcome of a trial; they rely on probability calculations based on previous court decisions, betting on the fact that judges tend to repeat their own decisions.

So, if an algorithm can predict the outcome of a legal dispute, why not replace the judge with a machine? After examining the technological advances in this field, we will explore not only their potential but also the risks and limitations involved. Isn’t “robotized” justice, in the end, synonymous with inhumane justice?
